By accessing, browsing, or using the Website, placing an order, or purchasing any products from us, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy, which is incorporated herein by reference. If you do not agree with any provision of these Terms, you must immediately discontinue use of the Website and refrain from placing any orders.
1.2 Modification of Terms
We reserve the right, in our sole discretion, to modify, amend, or update these Terms at any time without prior notice. Any modifications will become effective immediately upon posting on the Website. Your continued use of the Website or placement of orders after such modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically to ensure your continued compliance. We recommend that you print or save a copy of these Terms for your records.
1.3 Eligibility and Capacity
By using the Website and placing orders, you represent and warrant that: (a) you are at least eighteen (18) years of age and have the legal capacity to enter into binding contracts under applicable law; (b) if you are under eighteen (18) years of age, you have obtained the express written consent of your parent or legal guardian who agrees to be bound by these Terms on your behalf; (c) all information you provide is accurate, current, and complete; (d) you will maintain the accuracy of such information; and (e) your use of the Website and purchase of products is for personal, non-commercial purposes only, unless otherwise expressly authorized by us in writing.
2. PRODUCT INFORMATION AND AVAILABILITY
2.1 Product Descriptions and Specifications
We strive to provide accurate product descriptions, specifications, and measurements for all ready-made curtain products offered on the Website. All measurements are provided in centimeters unless otherwise specified. However, colors may appear differently due to variations in computer monitors, mobile device screens, photography lighting, fabric dye lots, and individual color perception. We recommend viewing products in person at our retail store if color accuracy is critical to your purchase decision.
2.2 Product Availability and Stock
All products are subject to availability and our acceptance of your order. We reserve the right, without prior notice and in our sole discretion, to limit the quantity of any product available for purchase, discontinue any product, or refuse to sell any product to any person or entity. In the event that a product you have ordered becomes unavailable after your order has been placed but before delivery, we will notify you promptly and offer you the option to: (a) wait for the product to become available again (timeframe to be determined based on supplier availability); (b) accept a substitute product of comparable quality, specifications, and color family; or (c) cancel your order and receive a full refund of any amounts paid. All notification periods, response timeframes, and refund processing will comply with applicable Kuwait consumer protection laws.
2.3 Pricing and Currency
All prices displayed on the Website are in Kuwaiti Dinars (KWD) and are exclusive of applicable taxes, delivery charges, and installation fees unless otherwise stated. Prices are subject to change at any time without notice, but price changes will not affect orders for which we have already sent you an order confirmation. In the event of a pricing error on the Website, we reserve the right to cancel any orders placed at the incorrect price and will notify you of such cancellation. If you have already been charged for the order, we will issue a full refund.
3. ORDER PROCESS AND PAYMENT
3.1 Order Placement and Confirmation
To place an order, you must complete our online checkout process and provide all required information, including but not limited to your full name, delivery address, contact telephone number, email address, and payment information. You may choose to create an account for faster future checkouts or proceed as a guest. You may optionally provide consent to receive order updates and delivery notifications via WhatsApp by selecting this option during checkout. Your order constitutes an offer to purchase products from us at the prices and on the terms specified. We reserve the right to accept or reject any order at our sole discretion. An order confirmation email will be sent to the email address you provide, but such confirmation does not constitute our acceptance of your order. Our acceptance occurs only when we charge your payment method and ship the products to you, at which time a binding contract is formed between us.
3.2 Payment Terms and Methods
Payment is due in full at the time of order placement. We accept the following payment methods: (a) major credit and debit cards (Visa, MasterCard) including digital wallet services such as Apple Pay and Google Pay; and (b) KNET (Kuwait National Electronic Transfer). All credit and debit card transactions are subject to authorization by the card issuer. If your payment method is declined or if we are unable to process payment for any reason, we may cancel your order without liability. You represent and warrant that you have the legal right to use the payment method provided and that all payment information is accurate and current.
3.3 Order Cancellation by Customer
You may cancel your order by contacting our customer service department at 24311100 in accordance with applicable Kuwait consumer protection laws. Cancellation requests will be processed subject to the order's current status in our fulfillment process. If your order has already been processed for shipment, it cannot be cancelled and must be returned in accordance with our return policy. For cancelled orders paid by credit or debit card, we will reverse the authorization or process a refund transaction as soon as possible, but we are not responsible for delays in the refund process due to bank or card issuer processing times.
4. DELIVERY AND RISK OF LOSS
4.1 Delivery Areas and Scheduling
We currently provide free delivery services to all areas within 40 kilometers from our store. Delivery charges are calculated as follows: free delivery within 40 kilometers of our store location, 2 KWD for addresses 40-50 kilometers from our store, and 4 KWD for addresses beyond 50 kilometers from our store. Order size may also affect delivery charges for very small orders. Standard delivery is typically completed within two (2) to three (3) business days from order confirmation. We will provide you with an estimated delivery date, but such dates are estimates only and we do not guarantee delivery on any specific date.
4.2 Delivery Requirements and Procedures
You must provide a complete and accurate delivery address, including building number, floor, apartment number, and any special delivery instructions. You or an adult representative (at least twenty-one (21) years of age) must be available to receive the delivery at the specified address during normal delivery hours. If no one is available to receive the delivery, our delivery service will attempt to contact you to reschedule. After two (2) unsuccessful delivery attempts, the order will be returned to our warehouse and you will be charged for redelivery. Risk of loss and title to products pass to you upon delivery to the address you specified, regardless of whether you or your representative personally received the products.
5. RETURNS AND REFUNDS
5.1 Return Window
You have 14 days from the delivery date to return eligible items in accordance with Kuwait consumer protection laws.
5.2 Eligible Returns
Wrong Items Delivered
If you receive an incorrect item due to our error, we will:
- Provide a full refund including the original shipping costs you paid, OR
- Send you the correct item at no additional charge (including free shipping for the replacement)
- Cover all return shipping costs for the incorrect item
Defective Products
If your curtains arrive with manufacturing defects or damage that occurred during shipping, we will:
- Provide a full refund of the purchase price, OR
- Replace the defective item with a new one at no additional charge (including free shipping for the replacement)
- Cover all return shipping costs for the defective item
5.3 Return Requirements
To be eligible for a return, items must meet all of the following conditions:
- Unused and unopened: Curtains must remain in their original sealed packaging
- Original condition: Items must show no signs of wear, damage, or alteration
- Complete package: All original packaging, tags, care instructions, and accessories must be included
- Proof of purchase: Original invoice or receipt must be provided
- Within timeframe: Return request must be initiated within 14 days of delivery
5.4 Non-Returnable Items
We cannot accept returns for:
- Curtains that have been removed from their original packaging
- Items showing any signs of use, wear, or damage
- Products returned without original packaging, tags, or accessories
- Items returned after the 14-day return window
5.5 How to Return Items
Option 1: Store Return (Recommended)
Visit our physical store location with your items and original receipt. Our staff will process your return immediately.

Option 2: Return Pickup Service
Contact our customer service to arrange pickup from your address.
- Cost: Customer pays return shipping fee (unless wrong item was delivered)

5.6 Refund Process
- Quality Check: We will inspect returned items within 3-5 business days of receipt

6. LIMITED WARRANTY
6.1 Product Warranty
We warrant that curtain products will be free from defects in materials and workmanship for thirty (30) days from delivery date, or as required by applicable Kuwait consumer protection law, whichever is longer. This warranty does not cover damage from misuse, normal wear and tear, or improper care.
6.2 Warranty Claims and Remedies
To make a warranty claim, you must contact us within the warranty period and provide your order number, photographs of the defect, and a description of the problem. If we determine that a product is defective and covered by this warranty, we will, at our option, either repair the product, replace it with an identical or substantially similar product, or provide a full refund. This warranty is non-transferable and applies only to the original purchaser. Our liability under this warranty is limited to the purchase price of the defective product.
7. RELATIONSHIP WITH SHOPIFY
Shaurya Furnishing is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make are made directly with Shaurya Furnishing. By using our Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Shaurya Furnishing, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Shaurya Furnishing.
8. THIRD-PARTY TOOLS AND LINKS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion.
9. ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
10. PROHIBITED USES
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (e) to submit false or misleading information; (f) to upload or transmit viruses or any other type of malicious code; (g) to collect or track the personal information of others; (h) to spam, phish, pharm, pretext, spider, crawl, or scrape; or (i) to interfere with or circumvent the security features of the service. We reserve the right to terminate your use of the service for violating any of the prohibited uses.
11. ACCOUNT TERMINATION AND RESTRICTIONS
We reserve the right to terminate, suspend, or restrict customer accounts at our sole discretion for the following reasons: (a) frequent or excessive returns that suggest abuse of our exchange policy; (b) creation of multiple accounts by the same individual; (c) providing false, inaccurate, or misleading information during registration or ordering; (d) chargeback disputes or payment fraud; (e) violation of these Terms and Conditions; or (f) any conduct that we determine, in our sole discretion, is harmful to our business interests or other customers. Upon account termination, all pending orders may be cancelled, and the customer forfeits any store credits or benefits. We will process legitimate refunds for delivered products in accordance with our refund policy.
12. INDEMNIFICATION
You agree to indemnify, defend and hold harmless Shaurya Furnishing, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, our total liability to you for any claims arising from or related to these Terms, your purchase, or use of our products shall not exceed the amount you paid for the specific product giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, business interruption, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages. This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, strict liability, or otherwise. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable Kuwait law.
14. INTELLECTUAL PROPERTY
14.1 Website Content Ownership
All content on this Website, including but not limited to text, graphics, logos, images, product descriptions, website design, and software, is owned by Shaurya Furnishing or our licensors and is protected by Kuwait and international copyright, trademark, and other intellectual property laws. You may access and use the Website for personal, non-commercial purposes only.
14.2 Prohibited Uses
You may not copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content, information, software, products, or services obtained from the Website without our express written permission. You may not use our trademarks, logos, or brand names without prior written authorization.
15. USER-GENERATED CONTENT
15.1 Customer Reviews and Content
Our Website may allow you to submit reviews, ratings, photos, comments, and other content ("User Content"). By submitting User Content, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media for any purpose related to our business operations.
15.2 Content Standards
You agree that any User Content you submit will: (a) be accurate and truthful; (b) not violate any third party's rights; (c) not contain offensive, defamatory, or inappropriate material; (d) not include personal contact information or spam; and (e) comply with applicable laws. We reserve the right to remove any User Content that violates these standards or that we deem inappropriate in our sole discretion.
15.3 Content Responsibility
You are solely responsible for any User Content you submit. We do not pre-screen User Content but reserve the right to monitor and remove content. We assume no liability for User Content posted by you or other users. User Content does not reflect our views or opinions.
16. SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
17. TERMINATION
We may terminate this agreement or your access to the Services in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections will continue to apply following any termination: Intellectual Property, User-Generated Content, Termination, Limitation of Liability, Indemnification, Severability, Governing Law, and any other provisions that by their nature should survive termination.
18. GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Kuwait. Any dispute shall be referred to the competent courts in Kuwait.
19. ENTIRE AGREEMENT
These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
